REGISTRATION AGREEMENT, RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING IT. THIS DOCUMENT HAS LEGAL CONSEQUENCES, WILL AFFECT YOUR LEGAL RIGHTS AND WILL LIMIT OR ELIMINATE YOUR ABILITY TO TAKE LEGAL ACTION IN THE FUTURE.
Whereas Ternua as the organizer of the training event accepts my registration for the event, including related programs and events (“Event”), I understand and acknowledge that by signing this document I am legally accepting the statements contained in the following Registration, Release and Waiver of Liability and Assumption of Risks and Indemnification Agreement (“Agreement”) and that such statements are accepted and deemed valid by the Contracting Parties as defined below. I hereby freely and voluntarily agree and/or take action on behalf of myself or on behalf of my spouse, children, parents, guardians, heirs, next of kin, and any legal or personal representatives, executors, administrators, successors and assigns, or any other person who may bring a claim or suit on my behalf, as follows:
1 HEREBY ACKNOWLEDGE AND ASSUME ALL RISKS INVOLVED IN PARTICIPATING IN THIS EVENT. I acknowledge that certain activities in this Event are potentially dangerous and may involve physical and mental exertion leading to potentially serious physical injury, permanent disability, paralysis and death, and damage to or loss of physical property. I acknowledge and agree that it is my responsibility to determine whether I am healthy and fit enough to safely participate in this Event, and I attest and certify that I am or will be sufficiently fit and physically prepared to participate in this Event, of which I elect to be a part. I certify that no health care professional has advised me against participating in this Event. I do not have any illness or physical condition that would put myself or others at risk if I participate in this Event, or that would interfere with my ability to participate safely. I agree that I am responsible for the condition and adequacy of my equipment for participation and for my conduct with respect to the Event. I understand and assume the risk involved in performing the activities of this Event and the risk involved in doing so under these circumstances. I also assume any other risks associated with participation in this Event including, but not limited to, falls; risks of collision with vehicles, pedestrians, other participants and permanent objects; risks posed by hazardous surfaces, equipment failure or inadequate safety equipment; and risks posed by spectators or volunteers and weather conditions. I further acknowledge that these risks include risks that may result from negligent acts, omissions and/or inattention of the Contracted Parties as defined herein. I understand that I will participate in this Event at my own risk and that I am responsible for the risks involved in participating in this Event.
2 I understand and acknowledge the dangers associated with the use of alcohol and drugs before, during or after the Event and acknowledge that the use of alcohol and drugs may impair my motor skills and judgment. I assume responsibility for any injury, loss or damage associated with the use of alcohol or drugs.
3 I HEREBY WAIVE MY RIGHTS, RELEASE AND FOREVER RELEASE the organizer of the Event, the sponsors, organizers and promoters of the Event, the agents and personnel of the Event, the advertisers, owners, volunteers, managers, contractors, suppliers, and all other persons or entities involved in the Event and all state, municipal or governmental agencies, and/or municipal agencies whose property or personnel are used and/or assist in any way at the locations at which the Event or portions of the Event takes place, as well as each of their parents, subsidiaries or affiliates, their licensees, officers, directors, partners, partners, board members, shareholders, members, supervisors, insurers, agents, employees, volunteers and other participants and representatives (separately or collectively the “Contracted Parties”) from any and all claims, liability of any kind, claim, damages (including direct, indirect, consequential, incidental, incidental, quantifiable and/or consequential damages), losses (economic and moral) and causes of action of any kind or nature that I have or may have in the future, including attorneys’ fees and court costs (separately or collectively the “Claims”), which may arise out of, result from or relate to my participation in the Event or my travel to or from the Event, including my death, personal injury, partial or permanent disability, negligence, damage to physical or other property, theft of property, and Claims related to first aid service, medical care and treatment, or medical decisions (at the Event site or elsewhere), and any Claims for medical or hospitalization costs, even if such Claims result from the negligent acts, omissions and inattention of the Contracted Parties.
4 FURTHER, I UNDERTAKE AND AGREE NOT TO SUUE any of the Contracted Parties for any Claims which I have waived, and from which I have hereby released and discharged. I AGREE TO INDEMNIFY, DEFEND, and HOLD HARMLESS the Contracted Parties for any expenses incurred, Claims asserted by me or other persons or entities, for liabilities asserted against the Contracted Parties, including, but not limited to, attorneys’ fees and court costs that may arise or result, directly or indirectly, in whole or in part, from my failure or omission to observe any part of this Agreement, from my failure or omission to observe any of the rules established by the teachers, Event Producer, and from my actions or failure to act which may cause injury or damage to others.
5 I hereby consent to receive such medical care and treatment as may be deemed advisable in the event of injury, accident or illness during my participation. If necessary, I authorize the Event Producer or any of its agents, employees, volunteers, affiliates and delegates, any organizer or sponsor of the Event, or any Event volunteer to consent to such medical care and treatment. I understand that this authorization is given before any specific diagnosis, treatment or hospital care is required, and is given to grant authority and power to render such care as the aforementioned may deem advisable using their best judgment.
I agree to be responsible and liable for any costs incurred as a result of my participation in the Event that are not covered by my insurance, including, but not limited to, medical care and treatment, ambulance services, hospitalizations, and medical and pharmaceutical products and services. I agree to indemnify and hold the Contracted Parties harmless for all such costs.
6 I hereby grant to the Event Producer ,, permission and authority to use, without compensation, my name, voice and likeness when taken during the Event by the Event Producer, its affiliates or contractors, and/or the media, in any photographs, videotapes, CDs, DVDs, transmission, broadcast, podcast, webcast, recording, film, commercial advertising, promotional material, and/or any other recording of this Event for any purpose whatsoever.
7 I acknowledge and agree that the Event Producer may, at its sole discretion, delay, modify or cancel the Event if it deems conditions to be hazardous. In the event that the Event is delayed, modified or cancelled for any reason including, but not limited to, acts of God or the elements (including, but not limited to, wind, heavy seas, rain, hail, hurricane, tornado, earthquake, terrorist acts, fire, threatened or actual walkout, labor difficulties, work stoppage, insurrection, war, public disaster, flood, accident, road conditions or any other cause beyond the Event Producer’s control, the Event Producer will not refund the amount of the registration fee or any other expenses incurred in connection with the Event.
8 By submitting my application to participate in this Event, I acknowledge the personal jurisdiction of the court located in Spain in any dispute arising in connection with my application or participation in this Event. I further agree that jurisdiction over any dispute arising out of my application or participation in this Event shall be brought in the same national, state or federal court. If any provision of this Agreement shall be deemed unlawful, void, or for any reason unenforceable, then such provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
12 The producer of the Event may postpone the date of the event and shall not be entitled to a refund of the registration fee, but may transfer it.
I HEREBY AFFIRM THAT I AM OF LEGAL AGE OR WILL BE OF LEGAL AGE ON THE DATE OF THE EVENT, THAT I HAVE READ THIS AGREEMENT, UNDERSTAND ITS CONTENTS AND SIGN IT INTENTIONALLY AND VOLUNTARILY.
